1. Terms and Conditions

• Commission is for personal use only. Not allow for commercial or advertising purposes. If you prefer to use them for commercial, please check What counts as commercial use?

• I reserve the copyright of my works and the right to publish them onto my portfolio and my social media. Private artwork or withholding the artist from posting will cost extra: 40% of commission total price.

• If for some reason, you want to "un-private" your commission, just send me a mail stating so. However, there are no refunds of the fee. The fee still counts for the period of time it was private.

• I own the rights to the painting (in case you don't buy the commission for commercial use), so I also have the right to print the commission painting into an artbook. But I will still ask your opinion first before printing artbook for sale (commercial) or giveaways (non-commercial).

• Please credit to Guntr97 somewhere visible with a link that redirects others back to my sns (eg. Instagram, Twitter, etc...)  including your personal website/blog. DO NOT claim it as your own, edit or distribute/re-sell to any third party markets or use for personal gains.

• I don't accept urgent commissions and please be patient during the process.

• Under no circumstances will I ever redraw an entire commission. Please state everything clearly and in full detail when ordering as I do it exactly as stated. If you insist on a redraw no matter what, you will simply have to commission me again.

• I already have an official and clear price list posted on my site, so whoever bids down will be blacklisted. I also do not accept installment payments.

• I also don't like using invoices for commission under 500$ when transacting via paypal, so if it's not a special case, you can send it in the usual way ( business payment, not family and friends )

• I have the right to refuse your commission request when I feel it is beyond my drawing ability.

• In case artist and client have a dispute or disagreement, client wants to fix too much after sketch and payment process and the artist feels that they can't continue to work anymore, the artist has the right to cancel the commission and refund 60% of total commissions value. The copyright of the sketch, the idea belongs to the artist. PLEASE NOTICE THIS.  

  • For clients whose commission was canceled by me after sketch and payment, I will consider carefully if there is a next time.

• In some paintings, I build the background and details  with 3d software or with available assets that are provided for free, sometimes purchased by me. So I will probably use them for many different drawings, if you happen to see some details in your painting that are a bit like the one I did for another client, that's completely normal for personal commission.

• Although I have many accounts in different social networks, I absolutely only trade commissions or merch business through the accounts I have shown in the contact section. If there are other accounts that post my paintings for commission or business purposes but do not belong to the accounts in the contact section, please let me know if possible as they may be fake my identity to scam . 

• TOS  will be updated once every half year

2. Payment and working process

• The payment has to be sent in 3 days after I accept it, if you have any struggle please tell me before hand.

• Payment is upfront via PayPal (USD), Transferwise or Vietnam local bank transfer / Momo wallet.   USD to VND will be calculated according to the market price.

• If you wish to tip (some people do), you may send it through the "buy a coffee" via my Ko-fi. I sincerely thank you from the bottom of my heart for valuing and appreciating artists' work.

• I will send you the sketch first. If you accept our deal, you have to pay 50% or full price first then i will start working on it.

• You could pay 50% first and pay the rest after when i finished or pay 100% up to you. Once the final render with my watermark on it is approved, please kindly transfer the rest and i will send you the final artwork without watermark. 

• Please consider carefully before commissioning me. I do not accept refunds ( except for disputes after sketch and payment) . For those who cancel commission after i send you the sketch, you will go into my blacklist and i will never take your order again. So please make sure before order. 

• In case you disappear after taking the sketch, I have the right to make the sketch (idea, layout....) my own and edit it as I please.

• Working process: 

  • Client send commission form 

  • I read brief and ask for more information if it's necessary

  • I send rough sketch with watermark through sta.sh/ drive / email ( The sketch at this stage is just a preliminary sketch for you to see the overall composition of the picture, so the details are not clear at all. Please do not ask to edit details such as "I don't see the character clearly, can you draw more clearly...." ) 

• Payment ( 50% or 100% )

• I receive payment and notify client through email/ message/ note to confirm payment

• Preview/Update drawing process   

• Fixing max three times if it's necessary

• Preview after fixing

• Finished and send watermark version ( if you choose pay 50% first) 

• Client pay 50% rest, and i will upload the final artwork full resolution without watermark through sta.sh/ drive. 

• Please save the picture within 1 month, because after 1 month I will delete the picture due to limited storage space. 

 

3. Commercial use - What counts as commercial use?

There are four price tiers:

• 1x price, not for commercial use

• Personal use means the drawing won't generate to you any kind of profit, and is something you wish to have for personal enjoyment.

• 1.5x price, when the artwork is not the bulk of the product, but on this tier the credits are obligatory and must be visible to the audience (e.g., a small "art by Hyanna-Natsu" in the corner of an image).

• 2x price, commercial use when the artwork is not the bulk of the product (promotional material, CD cover, game assets, social media artwork, etc.).

• 3x price, commercial use when the artwork is the bulk of the product (body pillow, postcard, merchandise, etc.).

• Does YouTube assets (banner, avatar, using art in videos) count as commercial? Yes, same for Patreon and any ad-supported sites.
  
   

4. What i can and cannot draw 

• I can draw : Original Character, Fanart ( Manga / Anime / Comic / Movie / Film / Game ), Anthros will look human-like, Kemonomi​, Mystical creatures with at least half human-like appearance ( Siren, Fairy, Mermaid, Vampire, Harpy, Demon/ Devil ... ), Couple ( Male x  Female, Female x Female, Male x Male ) , Vtuber, ...​

  • I'm nsfw artist. and i specialize in drawing nsfw.

• I also won't draw anything related to politics or religion (in real life).

• At the moment I'm very weak in drawing combat poses as well as dynamic poses, or difficult viewing angles like looking from the top down or from the bottom up. I hope you guys will think twice before asking me to draw something like this. 

• I do not accept background commission without characters in it. 

• For [ CHARACTER SHEET ] commission,  I only drawing characters sheet, not character designs. That means you need to have a concept of your character first, and then give me all the references for  that character, not necessarily a drawing, maybe a collection of pictures: outfits, hairstyles, body shape, personality, background, accessories ...

5. Commission form 

When order a slot,  please send me a note / mail / message with the following information:
 

       Your INFORMATION

• Name: Your name account

• PayPal Email: Your pp email

• Email: Your email ( optional ) 

• Other contact Information: (Where can I reach you and update you in case I cannot contact you on the current site?)

• What is the purpose of you using this commission? ( Personal / Commercial )

• Do you allow me to post the finished drawing on my social media?

• Am I allowed to record the drawing process?

• Which style do you want:  HEADSHOT/ BUST-UP/ HALFBODY / FULLBODY.
  CHARACTER’S INFORMATION 

• Character reference : Image references required 

  • For those who take CHARACTER SHEET Commission, It is not necessary to have oc drawings available, but you must provide me image reference of their appearance, such as his eyes like this [ image ], but eye color like this [ image ],... this is described in more detail and with an example in the [ CHARACTER SHEET COMMISSION ] section.

• Additional details that need special attention (face emotion, ear, tail color, a mole, tattoo or birthmark in a particular place on the body...):  If you don’t have any requirements, the character will follow my aesthetic. 

• Background : Your background reference ( if you choose adding background )

• What is your idea, the story you want to convey in the picture? What is your character doing and how is his expression? Why are they doing that and why have that expression? What kind of atmosphere do you want the painting to be (mysterious, happy, sad, desperate, gentle, relaxing, warm, .....) Do you have any special requirements about the color of the picture  ? 

  • You can write everything and send anything related to commission, because the more reference you send me, the faster i work. 

  • If your commission is simple then you only need to write what is necessary and concise, dont need answering all the questions.

• In case you have a picture in your head but can't describe it correctly, you can draw it as a simple stickman and annotate it like this

6. Commission FAQ

• Can I set a deadline?

  • You may set a deadline but it must be reasonable. I dont work on your art piece all the time. The minimum time need to be done is 1 week and the maximum is 1 months.
